1st May 2025 - May Member update.

The May Member update is being emailed to Members today, and is being loaded to Member Online login (latest Member update folder, and then May 2025).

The Member update includes best practice information on the following matters.

Rental application RTA Form 22.

Approved occupants.

Approved occupants under 18.

Open homes and the new section 195a – restriction of entry if notice to end the tenancy is given by either party.

Form 18a issued before May 1, 2025, but beginning after May 1 and not signed by all parties prior to May 1.

Our best practice forms – particularly disclosure consent best practice.

With the release of the final version of the RTA Form 22 rental application form, there are a number of disappointments.

In saying above, we move forward as always and do our best to work with what we’ve got.

I won’t waste much more time on the concerns as I’ve invested a great deal already.

I encourage Real Estate Excellence Members, and the industry to not put an actual property manager name on the approved form. One of the recommended changes I made to the RTA as part of the consultation was to use the correct terminology, namely Lessor/Agent.

This was obviously disregarded.

Technically there’s no such position of Property Manager in either our PO Act, or the RTRA Act.

Agent means representative of the Client. Which in our case, Agent is the named business who has the PO FORM 6 with the lessor client. The individual position of Property Manager is not the Agent.

This really matters. Hence my above recommendation to name the Agent as noted on the PO FORM 6, and the RTA FORM 18a on the RTA FORM 22.

Another final point is the regrettable administrative burden of pro forma completion by agent including ways to submit the application. This will mean if tenants access the FORM 22 from other means such as the RTA website, they will need to contact the Agent. It’s further interesting to note the inclusion of tenancy databases (whilst needed) isn’t in the regulations. This field is another administrative addition for agencies and private lessors.

There are a number of other matters I’m concerned about, but noting my opening statements, I will add in closing, it’s regrettable the Electronic Transaction Act wasn’t mentioned, given it’s noted in clause 44 of the Form 18a, and it’s a common practice to email required documents to the successful applicant.

I’m finalising a separate best practice document you may wish to use when a prospective tenant applies for a rental property using the new RTA FORM 22 tenancy application form. A reminder the laws commence 1 May, 2025.

The best practice document is currently 3 pages long. I cannot shorten it regrettably due to the important disclosures, information to be given to the applicant, plus obtaining necessary consents.

Once I’ve finalised, it will be emailed to Members as part of the April Member update service.

The best practice document will be provided in word version so you can finalise with your logo etc. It will be sent to you prior to May 1 laws commencing.

Dear Members,

The following information covers the May 1, 2025, tenancy laws change as part of Stage 2 tenancy law reform from page 3 21. The Mandatory CPD new laws under the Property Occupations Act are also included in this Member update. Refer from page 22.

The RTA Q and A will update with more questions and answers. We shall provide the information to Members once the information is updated by the RTA. Members are encouraged to also refer to the RTA link as provided in the Update and Ongoing rental law changes | Residential Tenancies Authority.. There will be an updated RTA Form 18a, and Form 9, plus a number of new RTA forms from May 1, 2025. Your prescribed/approved Form provider will advise you of the updates, and they will be at the RTA website from May 1.

Your agency may wish to provide your client lessors the RTA link, plus we have provided in a separate document a comprehensive summary from the Department of Housing on all the changes which you may use with your final edit to provide to your lessor clients.

Member are encouraged to read this best practice guide in full. This best practice guide is recommended to be used for a self-paced individual and or in office training session.

We shall continue to update Members as more information comes to hand. Noting there will be updates to the CPD information provided in this guide, and the RTA Q and A as mentioned above.
